Ministry of Commerce Announces: 90-Day Suspension of Some Countermeasures Against US Under China-US Economic and Trade Consensus!

Beijing – Recently, a spokesperson for the Ministry of Commerce provided a detailed explanation to the media regarding two significant measures in China-US economic and trade relations: the unreliable entity list and the export control management list. This move aims to implement the consensus reached during high-level China-US economic and trade talks, demonstrating China’s sincerity and flexibility in promoting the stable development of bilateral economic and trade ties.

Unreliable Entity List: Partial Measures Temporarily Suspended

 

The spokesperson noted that, in accordance with the “Anti-Foreign Sanctions Law of the People’s Republic of China” and the “Provisions on the Unreliable Entity List,” the Ministry of Commerce had earlier this month added 17 US enterprises to this list. These companies were prohibited from engaging in China-related import and export activities and restricted from making new investments within China.

 

However, in response to the consensus achieved during the high-level China-US economic and trade talks, the Ministry of Commerce decided to suspend the measures mentioned in the announcements of April 4th and 9th for some of these enterprises, effective May 14th, for a period of 90 days. During this interim period, if domestic enterprises need to conduct transactions with these US entities, they may submit applications to the unreliable entity list working mechanism, which will review and approve eligible applications in accordance with relevant regulations.

 

Export Control Management List: Dual-Use Item Export Restrictions Eased

 

Regarding the export control management list, the spokesperson further clarified that the Ministry of Commerce had previously, in accordance with relevant laws and regulations, listed 28 US entities on this list, prohibiting the export of dual-use items to them.

 

Similarly, to implement the consensus from the high-level China-US economic and trade talks, the Ministry of Commerce also decided to suspend these related measures for 90 days, effective May 14th. During this period, if any export operator needs to export dual-use items to these 28 entities, they should submit an application to the Ministry of Commerce in accordance with the “Regulations of the People’s Republic of China on Export Control of Dual-Use Items.” The Ministry of Commerce will review the applications in accordance with the law, and eligible applications will be granted licenses.

The spokesperson emphasized that the primary purpose of adjusting these measures is to implement the consensus reached during the high-level China-US economic and trade talks, fully demonstrating China’s sincerity and flexibility in economic and trade cooperation.
